Attorney Don Smolen of The Alpha Firm is speaking out following a deeply disturbing ICE-led raid that resulted in the unlawful detention and humiliation of a U.S. citizen and her three daughters in northwest Oklahoma City.
In April, federal agents—identified as members of ICE, the FBI, and the U.S. Marshals Service stormed the family’s home early in the morning. The mother and her children were forced outside in the rain—one of the daughters wearing only undergarments – while agents conducted a search and confiscated personal items, including cell phones, cash, and laptops. The family was not listed on the warrant. They had no connection to the individuals being investigated.
“This family wasn’t just traumatized, they were profiled, violated, and stripped of basic dignity because law enforcement failed to do their job,” said Smolen. “There was no excuse for it. None of their names were on the warrant. This is what happens when protocol is thrown out the window and prejudice walks in the door.”
Authorities later admitted the agents were acting on outdated intelligence. The property had previously belonged to a suspect in a human smuggling case, but the current occupants who had recently moved in from Maryland, had no connection to the ongoing investigation.
“How do you get something like this so wrong?” Smolen continued. “This family was targeted for one reason: they are of Mexican descent. That’s not law enforcement. That’s racial profiling. And it’s unconstitutional.”
Smolen and The Alpha Firm are calling for a formal investigation into the policies and procedures that led to the raid.
