Tulsa, OK — A lawsuit has been filed in Mayes County District Court on behalf of a ninth-grade student, K.A., against Chouteau-Mazie Public Schools (CMPS), alleging negligence that led to a serious assault during the 2021–2022 school year.
According to the complaint, K.A., a member of the CMHS baseball team, was repeatedly hazed and bullied by older teammates. This hazing included an act known as “tea bagging,” a degrading and non-consensual contact that meets the legal definition of sexual assault. Despite multiple warnings from students and parents, the school district allegedly failed to investigate the complaints, enforce its own anti-hazing policies, or provide adequate supervision in school facilities.
On January 17, 2022, the student was assaulted in the school locker room during a baseball-related event while no supervising adult was present. One student involved later pled guilty in federal court. The lawsuit claims that CMPS’s inaction created an unsafe environment and caused significant emotional and psychological harm to the victim.
“It’s not a prank. It is a criminal act,” said civil rights attorney Don Smolen, who is representing the family. “Where was the coach? Where was the staff responsible for these children? This student was failed by the very people who were supposed to protect him.”

The victim has since been withdrawn from the school and is receiving ongoing support. The family is seeking damages in excess of $75,000 and is pursuing all available legal remedies.
“This is not something a child should ever experience and we will not allow this case to be swept under the rug,” Smolen added. “We are calling on parents, educators, and lawmakers to stand with us.”
