Smolen Law Warns of Coordinated Attack on Victims’ Rights Ahead of Critical March 24 Hearing

Tulsa, OK — Smolen Law is calling urgent attention to three coordinated bills moving through the Oklahoma Legislature that could drastically undermine the rights of injured Oklahomans. These proposals — SB 1065, HB 2682, and HB 2681 — represent a sweeping attempt to limit civil justice, protect powerful interests, and silence victims.

A public hearing on SB 1065 is expected Monday, March 24, 2025, at the State Capitol in Oklahoma City. If passed, this bill would cap noneconomic damages (like pain and suffering) at $500,000, regardless of the severity of harm — even in cases of wrongful death, medical malpractice, or catastrophic injury.

“This is not reform — it’s a full-scale attack on the civil rights of Oklahomans,” said Don Smolen, Managing Partner at Smolen Law. “The fact that lawmakers are pushing multiple bills at once — and trying to quietly bring back caps that were already ruled unconstitutional — should alarm every single citizen in this state.”

The Legislation at a Glance:

SB 1065 – Reinstates unconstitutional damage caps on pain and suffering.

HB 2682 – A shell bill labeled the “Torts Reform Act of 2025” with broad, undefined potential to reshape civil justice.

HB 2681 – Alters legal standards in product liability lawsuits, creating hurdles for victims.

Smolen Law’s Position:

These bills would tip the scales of justice in favor of insurance companies, corporations, and negligent parties — while stripping power from juries and limiting fair compensation for victims and families.

We strongly urge the public, survivors, and legal professionals to:

  • Attend the March 24 hearing at the Capitol

  • Contact their state legislators

  • Share this information and stand up for civil justice
