Paulding v. Progressive Direct Ins.

On August 7, 2026, a jury in the Northern District of Oklahoma assessed a US$40 million award against Progressive to pay to one of its customers. The plaintiff had been injured in an accident with an uninsured driver and sought damages related to Progressive’s alleged breach of its contract and duty of good faith and fair dealing for its handling of and delays in responding to her uninsured motorist claim. The plaintiff ultimately won on her claim for bad faith and received US$20 million in actual damages and US$20 million in punitive damages.
